Terms of Service

These Terms of Service ("Terms") govern your use of Toss: Recipe Book (the "App"), operated by Abrar Albaqsumi ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using Toss, you represent that you meet this requirement. The App is not directed to children under 13, and we do not knowingly collect personal information from them.

2. Your Account

To use most features, you need to create an account. You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us immediately at support@tossrecipebook.com if you suspect unauthorized access.

You may delete your account at any time from Settings → Account → Delete Account. Deletion is permanent.

3. Subscriptions and Billing

Toss offers paid subscriptions through the Apple App Store. Available plans:

3.1 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

3.2 Managing or canceling your subscription

You can manage subscriptions and turn off auto-renewal in your Apple ID account settings on your device after purchase. Deleting the App does not cancel your subscription.

3.3 Free trial

If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription, where applicable.

3.4 Refunds

All purchases are processed by Apple. Refund requests are handled by Apple under their App Store Terms. We cannot directly issue refunds for App Store purchases.

4. AI-Powered Features

Toss provides AI-powered features such as recipe import, recipe generation, and translation, powered by third-party AI services (Anthropic). You acknowledge that:

Always verify cooking temperatures and times for food safety. The App is a kitchen helper, not a substitute for sound cooking judgment.

5. User Content

You retain ownership of all recipes, photos, notes, meal plans, and other content you create or upload in the App ("Your Content"). By using the App, you grant us a limited license to store and process Your Content solely to provide the App's features (e.g., to display your recipes back to you, sync them across devices in the future, or process them through AI features at your request).

You are solely responsible for Your Content and for ensuring you have the right to use any recipes, images, or text you import or upload.

The App, including its name, logo, design, source code, and all original content (excluding Your Content), is the property of Abrar Albaqsumi and is protected by copyright, trademark, and other applicable laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Third-Party Services

The App relies on services provided by Apple, Google (Firebase, Google Sign-In), and Anthropic. Your use of those features is also subject to their respective terms and privacy policies. We are not responsible for outages or changes in third-party services that affect the App.

9. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be error-free or uninterrupted.

We do not warrant that recipes, nutritional information, cooking times, or AI-generated content are accurate, complete, or safe for your specific dietary needs or allergies.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Abrar Albaqsumi, the operator of Toss, be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, food spoilage, allergic reactions, or any damages resulting from your use of (or inability to use) the App.

Our total liability for any claim arising from these Terms or your use of the App is limited to the amount you paid us (via Apple) for the App in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Significant changes will be communicated through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Kuwait, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these Terms or the App shall be resolved in the competent courts of Kuwait City, Kuwait.

If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections, this clause does not deprive you of any rights you have under applicable mandatory law.
